INSTALLATION OF THE PRODUCTS PURCHASED FROM SOUNDOWN CORPORATION SHALL INDICATE YOUR ASSENT TO THE FOLLOWING LIMITED WARRANTY AND LIMITATION ON REMEDIES.
Soundown Corporation warrants that the products manufactured by it shall be free from defects in workmanship or material for a period of one (1) year after the date of purchase. This warranty shall become void if Soundown Corporation determines the warranted products were improperly installed, misused or neglected. The purchaser assumes the obligation for proper installation, use and care of the warranted products.
The obligations of Soundown Corporation under this limited warranty are limited to repair or replacement, at its factory, of it products claimed to be defective. The obligations of Soundown Corporation to repair or replace shall be limited to warranted products which are returned (with delivery charges prepaid) within one year after the date of purchase. Soundown Corporation reserves the right to repair or replace only those parts or components of warranted products which it determines to be defective.
The foregoing remedy is in lieu of and Soundown Corporation shall not be liable for any special, indirect, incidental or consequential damages arising from use of its products. This limited warranty is in lieu of all other warranties, whether express or implied which are hereby disclaimed to the extent permitted by applicable law. No representative of Soundown Corporation has authority to modify this limited warranty or statement of remedies.
Statements that foam plastic materials are "fire retardant" or "self-extinguishing" indicate only that the materials contain a fire retardant or self-extinguishing additive, but are not intended to imply or suggest that such plastic foams are "non-burning". Foam plastic materials are combustible and can be ignited by an open flame. The burning characteristics of plastic foam vary considerably depending on amounts of material present and other combustible conditions. If ignited, plastic foams can burn rapidly and produce dense smoke. Numerical flame numbers are not intended to reflect hazards in plastic foam materials under actual fire conditions.
